Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kissa (the “Service”), operated by Texotic Software Solutions. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Community Guidelines, Privacy Policy, and — if you publish here — the Creator Agreement. Every policy is listed in the Legal Centre.

1. Eligibility & accounts

You must be at least 18 years old to use the Service — it carries mature content and is not intended for children. You are responsible for your account credentials and for all activity under your account. Keep your password confidential and tell us promptly at security@kissa.texotic.in of any unauthorised use. Provide accurate information when you register, and keep it current. One person, one account.

2. The Service

Kissa gives you a personal, non-exclusive, non-transferable, revocable licence to access and listen to or read content on the Service for your own non-commercial use. That licence does not let you copy, redistribute, re-upload, publicly perform, or resell content, or use it to train machine-learning models. See Licensing.

The Service is free — see Payments & Refunds. We may change, suspend, or discontinue features at any time. We aim to give notice of material changes, but we do not guarantee uninterrupted availability.

3. Creator content & licence

Creators retain ownership of the audio, images, and other content they upload (“Creator Content”). By uploading Creator Content, you grant Kissa a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, encode, reproduce, stream, cache, and display that content for the purpose of operating and promoting the Service.

You represent that you own or have the necessary rights to all Creator Content you upload, including any voices, music, and images, and that it does not infringe the rights of any third party. 4. Acceptable use

You agree not to use the Service to:

• upload content that is unlawful, infringing, defamatory, or that you do not have the rights to;
• upload sexual content involving minors, or content that incites violence or hatred;
• harass, impersonate, or deceive others;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
• scrape, resell, or redistribute content without authorisation;
• artificially inflate plays, likes, or follows, or evade a restriction we have placed on you.

5. Content moderation & intermediary status

We may review, remove, or restrict content and suspend or terminate accounts that violate these Terms or applicable law. Where we act against your content or account, we tell you which rule applied and give you a route to appeal, unless the law prevents us.

Kissa is an intermediary under the Information Technology Act, 2000, and acts on valid reports of unlawful content in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not author or endorse Creator Content — see the Content Disclaimer. To report content, use the in-app Report action; for copyright, see Copyright & Takedowns; for a formal complaint, see Grievance Redressal.

6. Intellectual property

The Service’s software, design, and trademarks are owned by Texotic Software Solutions. These Terms do not grant you any right to our branding except as needed to use the Service.

7. Privacy

Our handling of your personal data is governed by the Privacy Policy and Cookie Policy. Using the Service means you have read them.

8. Disclaimers & liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. To the maximum extent permitted by law, Texotic Software Solutions is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, or for content published by creators.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

9. Indemnity

You agree to indemnify Texotic Software Solutions against claims, damages, and reasonable legal costs arising from your breach of these Terms, or from content you published in breach of someone else’s rights.

10. Termination

You may stop using the Service and delete your account at any time — see Delete Your Account & Data. We may suspend or terminate access for breach of these Terms, or where the law requires it. Where the breach is not serious, we aim to give notice and a chance to fix it first. Sections 6, 8, 9, and 11 survive termination.

11. Governing law & disputes

These Terms are governed by the laws of India, and the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes. Before going to court, please raise the issue through Grievance Redressal — most problems are resolved there.

12. Changes to these Terms

We may update these Terms. The date at the top reflects the current version. For material changes we give notice in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
