Creator Agreement

These terms apply from the moment you activate a creator account and publish on Kissa. They sit on top of the Terms of Service — where the two conflict on a creator matter, this document wins.

This agreement is between you and Texotic Software Solutions, operator of Kissa. It incorporates our Terms of Service and Community Guidelines. If you do not accept it, do not publish on Kissa.

1. Becoming a creator

  • Creator access is self-serve. You describe what you intend to make, pick your genres, and your account is upgraded immediately.
  • You must be at least 18 and legally able to enter into this agreement. If you are publishing on behalf of a company or a group, you confirm you are authorised to bind it.
  • One person, one creator account. Do not run a second account to evade a restriction.

2. You keep ownership of your work

You own everything you upload — your audio, your images, your scripts, your characters. This agreement transfers no ownership to us and is not exclusive: you remain free to publish the same work on YouTube, Spotify, your own site, or anywhere else.

3. The licence you grant us

So that we can actually run the service, you grant Texotic Software Solutions a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, encode, reformat, stream, cache, and display your content, and to make copies as needed for backup and delivery through our CDN.

We may also use your cover art, series title, and short extracts to promote Kissa and your work — in the app, on our website, in emails, and on our social channels. If you would rather we did not use your work in marketing, email hello@kissa.texotic.in and we will honour it.

The licence lasts while your content is on Kissa. When you delete content, the licence ends for new uses, and we remove it from public access. Copies may persist briefly in CDN caches and backups until they expire.

We do not use your content to train machine-learning models, and we do not licence it to anyone else to do so.

4. What you promise us

For everything you publish, you confirm that:

  • you own it, or hold every licence, release, and permission needed — including for music, sound effects, images, and any writing that is not yours;
  • every voice in it is yours, or belongs to someone who consented in writing, or is a licensed synthetic voice you are permitted to use commercially;
  • it does not infringe anyone’s copyright, trademark, privacy, or publicity rights;
  • it complies with our Community Guidelines and with Indian law;
  • any real person depicted or identifiable in it has consented, where the law requires their consent.

Keep your paperwork. If a complaint arrives, we will ask you for the licence or release, and we act on the evidence in front of us.

5. Review and publishing tiers

  • New creators. Everything you publish is held for human review before it becomes publicly visible. This normally clears quickly.
  • Trusted creators. After a track record of approved episodes, your work goes live as soon as you publish it, and is reviewed reactively.
  • Publishing is not the same as being visible. Content is public only once it is both published by you and approved by moderation.
  • We may move you back to the review tier if you breach the guidelines, and we may remove or delist content at any time. We tell you which rule applied and why, and you can appeal.

6. Your responsibilities as a publisher

  • Label your work accurately — genre, description, and cover must match what is actually in the episode. No clickbait covers or misleading titles.
  • Warn listeners about content that goes beyond what the genre implies — graphic violence, suicide, sexual assault — in the episode description.
  • Do not artificially inflate plays, likes, or follows.
  • Respond to us if we contact you about a complaint against your content.

7. Money

Kissa currently pays creators nothing and charges listeners nothing. There is no revenue share, no tipping, and no subscription — see Payments & Refunds. If we introduce monetisation, it will be governed by separate terms you actively opt into. Nothing in this agreement obliges either of us to pay the other.

8. Your data and analytics

We give you statistics about your own content — plays, likes, followers. Listener data behind those numbers is aggregated and never identifies an individual listener to you. You may not attempt to de-anonymise it or to contact listeners through data obtained from the platform.

9. Ending this agreement

  • You can leave at any time. Unpublish or delete your content, or delete your account — see Delete Your Account & Data.
  • We may suspend or terminate your creator access for breach of this agreement, the Terms of Service, or the Community Guidelines, or where the law requires it.
  • Sections 4 (your promises), 10 (indemnity), and 11 (liability) survive termination.

10. Indemnity

You agree to indemnify Texotic Software Solutions against claims, damages, and reasonable legal costs arising from content you published in breach of section 4 — most often, a rights holder claiming you did not have permission to use their work.

11. Liability

We provide the platform as-is. We do not guarantee any level of audience, availability, or income, and we are not liable to you for indirect or consequential loss, including lost opportunity, arising from moderation decisions, downtime, or removal of content.

12. Changes and governing law

We may update this agreement; material changes are announced in the creator studio before they take effect. This agreement is governed by the laws of India, and the courts at Mumbai, Maharashtra have exclusive jurisdiction. Disputes can also be raised through Grievance Redressal.
